Terms of Service

1. Acceptance of Terms

By accessing and using the services provided by MapleMover Pro ("Company," "we," "us," or "our"), you ("Customer," "you," or "your") agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and MapleMover Pro.

If you do not agree to these Terms, you may not use our services or website. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting on our website.

3. Services Provided

MapleMover Pro provides professional moving and related services across Canada, including but not limited to:

  • Local residential and commercial moving
  • Long-distance and interprovincial moving
  • Packing and unpacking services
  • Storage solutions
  • Specialty item moving
  • Moving consultation and planning

All services are subject to availability and applicable regulations in the origin and destination locations.

4. Estimates and Quotes

4.1 Estimate Types

  • Non-binding Estimates: Approximate costs based on information provided; final charges may vary
  • Binding Estimates: Fixed price agreements that will not exceed the quoted amount
  • Binding Not-to-Exceed: Maximum price with potential for lower final cost

4.2 Estimate Validity

Written estimates are valid for 30 days from the date of issue unless otherwise specified. Estimates are based on information provided by the customer and are subject to change if actual conditions differ from those described.

4.3 Additional Charges

Additional charges may apply for services not included in the original estimate, including but not limited to:

  • Extra stops or route changes
  • Long carry charges
  • Stair or elevator fees
  • Storage services
  • Packing materials
  • Delays beyond our control

5. Booking and Scheduling

5.1 Booking Requirements

To confirm your move, you must:

  • Provide accurate and complete information
  • Sign a written moving contract
  • Pay any required deposit
  • Provide valid contact information

5.2 Cancellation Policy

  • More than 7 days notice: Full refund of deposit
  • 3-7 days notice: 50% of deposit refunded
  • Less than 3 days notice: Deposit forfeited
  • Day of move: Full charges may apply

5.3 Rescheduling

Moves may be rescheduled subject to availability. Rescheduling fees may apply for changes made within 48 hours of the scheduled move date.

6. Customer Responsibilities

6.1 Pre-Move Responsibilities

  • Provide accurate inventory and move details
  • Secure necessary permits and authorizations
  • Prepare items for moving (disconnect appliances, etc.)
  • Arrange for child and pet care on moving day
  • Clear pathways and ensure adequate access
  • Separate and identify items not being moved

6.2 Moving Day Responsibilities

  • Be present or have an authorized representative available
  • Provide clear instructions to the moving crew
  • Inspect and sign inventory lists
  • Note any pre-existing damage
  • Ensure payment arrangements are in place

6.3 Prohibited Items

The following items cannot be moved and must be handled by the customer:

  • Hazardous materials (paint, propane, chemicals)
  • Firearms and ammunition (unless properly licensed)
  • Perishable food items
  • Live plants (for long-distance moves)
  • Personal documents and valuables
  • Illegal substances or items

7. Payment Terms

7.1 Payment Methods

We accept the following payment methods:

  • Cash
  • Certified cheque or money order
  • Credit cards (Visa, MasterCard, American Express)
  • Debit cards
  • Electronic transfer (with prior arrangement)

7.2 Payment Schedule

  • Local moves: Payment due upon completion
  • Long-distance moves: Payment due before delivery
  • Storage services: Monthly payment in advance
  • Corporate accounts: Net 30 days with approved credit

7.3 Late Payment

Late payment charges of 2% per month may be applied to overdue accounts. We reserve the right to place items in storage at customer expense for non-payment.

8. Liability and Insurance

8.1 Basic Carrier Liability

Unless additional valuation is purchased, our liability is limited to $0.60 per pound per item. This basic protection is included at no additional charge but provides minimal coverage.

8.2 Declared Value Protection

Customers may purchase additional protection based on the declared value of their shipment. This protection is available for an additional charge and provides broader coverage.

8.3 Limitation of Liability

Our liability is limited to the actual value of lost or damaged items, not to exceed the declared value. We are not liable for:

  • Acts of God or natural disasters
  • War, terrorism, or civil unrest
  • Government actions or regulations
  • Customer negligence or failure to follow instructions
  • Normal wear and tear
  • Inherent vice of the goods
  • Consequential or indirect damages

8.4 Claims Process

Claims for loss or damage must be filed within 30 days of delivery. All claims must be submitted in writing with supporting documentation.

9. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to:

  • Weather conditions
  • Natural disasters
  • Government actions or regulations
  • Labor disputes
  • Equipment failure
  • Road closures or traffic restrictions
  • Acts of terrorism or war

10. Dispute Resolution

10.1 Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

10.2 Dispute Resolution Process

  1. Direct Communication: Attempt to resolve disputes through direct communication with our customer service team
  2. Mediation: If direct communication fails, disputes may be submitted to mediation
  3. Arbitration: Binding arbitration may be required for unresolved disputes
  4. Legal Action: Any legal action must be commenced within one year of the incident

10.3 Jurisdiction

Any legal proceedings shall be conducted in the courts of Ontario, Canada, and you consent to the jurisdiction of such courts.

11. Regulatory Compliance

MapleMover Pro operates in compliance with all applicable federal and provincial regulations, including:

  • Transport Canada regulations for interprovincial moves
  • Provincial moving regulations
  • Motor Vehicle Transport Act
  • Consumer protection legislation
  • Privacy and data protection laws

12. Website Terms

12.1 Website Use

By using our website, you agree to:

  • Use the site for lawful purposes only
  • Not interfere with site operations
  • Not attempt to gain unauthorized access
  • Not upload malicious content
  • Respect intellectual property rights

12.2 Intellectual Property

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable.

15. Entire Agreement

These Terms, together with your signed moving contract and our Privacy Policy, constitute the entire agreement between you and MapleMover Pro. No verbal agreements or representations not contained herein shall be binding.
